So that we may help give the best experience and pricing to our customers we have laid out our policies and terms. By completing your purchase on the California Candle Supply webpage you are agreeing and have read all policies and terms on this page. In regards to the policies and terms on this webpage words such as: you, your, customer, customers, user, users, purchaser, purchasers, buyer, buyers, references the purchasing agent(s) and product user(s). Additionally words such as: we, us, representative, representatives, is in reference to California Candle Supply and its representatives.

 

 

  1. Purchases and Payments

 

We accept most major credit cards through our website check out process. By completing your purchase you are agreeing and have read all policies and terms on this page. Our credit card processor utilizes a fraud detection service called No Fraud. No Fraud has permission to check and advise on each purchase placed through our webpage. They use metrics to determine the identity of the purchaser to validate each purchase. You agree the and understand to the usages of these metrics to identify users making purchase such as and are not limited to: billing address records, shipping address records, banking information, card information, geo-location, etc. Purchases may be put through a review process in which No Fraud has permission to reach out to the purchaser by phone, text, or email to ask for additional information in regards to identifying the purchaser in validating their purchase. If a purchase fails validation in accordance to No Fraud's review process California Candle Supply reserves the right to cancel your order. In the event of an order cancellation due to suspected fraud California Candle Supply will process a refund to the credit card processor. Refunds may take up to 3 business days to process or longer depending on, but not limited to holidays, credit processing times, bank processing times, etc. California Candle Supply makes an effort to reach out to each customer who's order is cancelled or placed or under review. Cailfornia Candle Supply may send a PayPal invoice to reactivate orders if they, but no limited to, have failed No Fraud's review process or an order is cancelled due to suspected fraud. California Candle Supply does not actively store payment information and uses the review process from both No Fraud and the credit card processor to determine if a purchase is valid.

  2. Product Usages and Safety

 

It is the responsibility of the purchaser and/or the individual using the products from California Candle Supply to conduct the necessary tests to ensure the quality and safety of the product and/or finished product. In no way is California Candle Supply responsible for any adverse reactions or changes in quality due to the mixture of items/products purchased from California Candle Supply or mixed with other items/products from any other source. For this reason California Candle Supply recommends to test all products or finished products before creating items in bulk or offering products or finished products to others. It is responsibility of the purchaser and/or individual to comply with all laws when using products from California Candle Supply and to ensure safe products whether these items are being used, sold, or given away. It is the responsibility of the purchaser and/or individual using products from California Candle Supply to ensure all posted specifications and limits are followed to ensure further safety. In no way is California Candle Supply responsible for any damage whether to a person or property in the usages of their goods.

  3. Returns and Exchanges

 

Items may be returned or exchanged within 60 days of the original purchase date. In order for an item to be eligible for return it must be unused, all parts or portions accounted for, and still in a sell-able condition based on California Candle Supply's review and determination of the condition of the product at the time of receiving the return or exchange. California Candle Supply retains the right to deny or accept any return for any reason. It is the customer's responsibility to return or exchange the product at their own time and expense or in order to initiate the return or exchange process. California Candle Supply recommends that each person looking to return or exchange a product reach out to us beforehand so that we may aid in determining the return eligibility. We also recommend to include a copy of the original invoice and to write the order number on the outside of the packaging. If we are unable to identify from which customer a return or exchange originated from or we are unable to locate the original purchase we may not be able to complete the return or exchange process. It can take, but is not limited to up to 3-5 business days for a return or exchange to process from the point of receiving back the original items meant for return or exchange. California Candle Supply is under no obligation to ship back items or return items to the customer in the event of an ineligible return or exchange. California Candle Supply reserves the right to determine the eligibility of all returns and exchanges. Shipping charges are not eligible for return or exchanges. Customers will be expected to purchase their own shipping labels and to pay their own shipping costs when returning or exchanging items. Customer's may reach out to California Candle Supply in regards to help or to request an assisted return. In the event of an assisted return California Candle Supply may help supply shipping labels for the return at the customer's own expense. California Candle Supply may send invoices or deduct the assisted returns cost from the refund or exchange. California Candle Supply has the right to deny an assisted return for any reason. 

  4. Order Cancellations and Modifications

 

For the purposes of the paragraph below words such as: written, e-mail, text, note, words, texts, notes, notation, notations, e-mails, is in reference to any written corresponding communication between California Candle Supply and its customers.

Order cancellations or modifications may only take place before an order is shipped or picked up from our location. It is the responsibility of the customer to contact California Candle Supply, communicate, and correspond with a California Candle Supply representative to cancel or modify an order. An order may be considered unchanged or active in the event if the customer wishes to cancel or change it unless written communication from California Candle Supply is received. California Candle Supply retains the right to not allow cancellations or changes to any order. California Candle Supply will have the sole discretion in regards to determining the authentication and meaning of any written correspondence between California Candle Supply and its customers.

  5. Purchasing Out of Stock Items or Pre-Orders

 

Customers may in most case purchase items that are not currently in stock on calcandlesupply.com. These transactions are considered to be Pre-Ordered Purchases to be released and shipped on the estimated availability date listed on the individual product. All items in the shopping cart are configured and priced to be shipped together. If any cart or invoice contains an Out of Stock or Pre-Ordered item the whole order in its entirety will not be shipped until the Pre-Ordered Item becomes available. If you would like for items to be shipped separately we recommend placing multiple orders with the pre-ordered items in their own cart. We have the right to bill for extra shipping charges if you wish to have the in-stock items shipped separately from their pre-ordered items if they were placed on the same order

  6. Custom Invoicing

 

California Candle Supply representatives may send custom invoices to our customers for specialized orders, order add-ons, by request, to reactivate a cancelled order, or whenever a California Candle Supply representative sees fit. Invoices may be sent by, but not limited to, e-mail, PayPal, etc. A PayPal invoice when provided by a representative is considered an official document and when this invoice is paid for the customer acknowledges all information is correct including name, shipping address, billing address, products, prices of products, shipping, and tax.  It is the customer's responsibility to verify all information is correct on the invoice before paying. By paying the customer agrees all information is correct. California Candle Supply reserves the right to cancel any order.

  7. Resale Purchasing

 

Customers who reside in California and Florida may submit their state sellers permit or resale certificate to California Candle Supply to purchase items for resale. Customer's may visit the support the tab after creating a login and logging into the webpage. Customers will find a button that reads Resale Registration. Upon completing the forms and sending all necessary information that is required it may be reviewed by a representative. Accounts that pass review will be upgraded for Resale purchasing which waives the tax for resale eligible purchases or when items are being purchased for resale. California Candle Supply has the right to approve or deny or resale application. Resale applications can take up to, but no limited to, 2-3 business days. We attempt to validate each permit on the state website in which the customers are filing from. We look for the following, but limited to, information to match to further aid in validation: name, business name, address, shipping address, billing address, etc. We ask our customers registering for resale purchasing to please wait for the confirmation as taxes can not be refunded once charged.

  8. Shipping Policies and Procedures

 

  • Orders are currently being fulfilled and shipped out within 1-2 business days
  • Orders taken on Saturday and Sunday will not be processed until Monday morning. We strive to fit all your purchased contents into one box in a neat and secure fashion to ensure your item arrives in perfect condition at the best value.
  • Please be mindful of your tracking number that we provided. At the time of fulfillment of your order a tracking number is sent to the e-mail you provided.
  • Orders are shipped on a first-come-first-serve basis. If you need your order expedited please request to do so by phone or email.
  • Orders are not typically shipped on Sundays or Saturdays unless a prior arrangement was made.
  • We reserve the right to change or modify your shipping selection. This may be done to better meet the requirements of the items desired, allow for a more expedited shipping option, to better protect the shipping contents, or to better meet the incurred shipping charges. We reserve the right to bill for shipping charges in the case of a shipping quote error or if an invalid shipping option was selected at the check-out. IE. USPS Padded Envelope. You will be contacted in one more of the following ways: website message, email, or phone call. Your order may be held until the shipping charges are paid and processed.
  • It is the customer’s responsibility to input the correct shipping information and intended destination in regards to their order. California Candle Supply is not responsible for any delays, fees, or shipping refunds in regards to incorrect shipping information that was provided from the customer. Do note that shipping carriers do not refund the shipping charges in the case of wrong input addresses, address corrections, and/or package retrievals in regards to a cancellation order or shipping address correction. In all cases the customer is responsible for the shipping charges and/or additional fees. California Candle Supply will not pay for these fees or refund the shipping back to the customer.
  • Any damage incurred to any items must be reported back to California Candle Supply within 60 days of when the order was placed in order to be eligible for any replacement items or refunds. It is the customer’s responsibility to retain all broken products, boxes, or packing materials as proof of damage is required by the shipping carrier. It may be required in the case of damage or missing items that the items stay in unused condition unless otherwise stated by a California Candle Supply representative until the investigation or claim process with the shipping carrier is completed. California Candle Supply retains the right to ask for any proof of the damage or missing items which may include but is not limited to pictures of damaged product, products, boxes, packaging materials, and the original shipping label.
  • Unless otherwise specified, in most cases your order may be left without the requirement of a signature. You may in advance request for a signature confirmation for the delivery of your package. This must be asked for in advance of placing the order as their are usually extra fees that are involved that the customer is responsible for.
  9. Orders issues involving Delayed, Damaged, Lost, Missing, Stolen, etc

 

California Candle Supply is not responsible for any order regarding but not limited to, Delayed, Damaged, Lost, Missing, Stolen, etc. A successful delivery confirmation from a shipping carrier releases California Candle Supply of any liability. It is the customers responsibility to report order issues to California Candle Supply within 60 days of the order date. The customer understands that after 60 days that California Candle Supply may not be able offer any assistance in regards to the customer's order issue. California Candle Supply does not offer any guarantee on any delivery ETA. The customer understand that in regards to a delayed order California Candle Supply will offer no compensation, credit, or refund. California Candle Supply retains the right to inquire for more information from the customer to offer aid in regards to an order issue. This information may involve, but is not limited to, customers name, items, order number, shipping address, billing address, freight forwarding information, place of delivery, information regarding the delivery of items in their area, photos of the product, shipping label(s), or packaging, etc. In the event of a damaged order, California Candle Supply may ask for photo proof of the damage done to the items as this is usually required by the shipping carrier. In the event of a lost order shipping carriers may check the GPS ping on where the delivery took place at the time when package was scanned and dropped off. This GPS ping may be all that is needed for the shipping carrier to determine successful delivery after a claim is input by a customer or a California Candle Supply representative. It is the customer’s responsibility to retain all items in regards to a shipment in the case of the damage or missing items. Proof of damage or missing items may be required for refunds or replacement items to take place as this is required by the shipping carriers. California Candle Supply retains the right to ask for proof of damage or missing items to correct, refund, credit, exchange or replace items. This proof includes but is not limited to photos of the products, damaged product, boxes, packaging materials, and the original shipping label or labels. Most order issues are reported directly to the shipping carrier. They in turn may start a claims process to investigate the order issue. This claim process can take as long as 30 days. California Candle Supply may have to wait for the claims process to complete before being able to offer assistance in regards to an order issue.

  10. Route Package Protection

 

Route is a third party partner that offers tracking services and service protection which extends insurance for online purchases that are lost or damaged in transit, or stolen immediately after the carrier’s proof of delivery where Route traces the transportation. It is the customer’s responsibility to opt in or out at the time of check-out depending on whether they wish to have the optional coverage protection from Route. Please process any Route Claim via the Route notifications that are sent to your email of choice. Claims for Lost, Damaged, or Stolen items can be processed there. Route will provide refunds or allow us to send replacement products when a claim is successfully processed. Route must be selected and purchased at the time of check out to be eligible for coverage from Route. Route requires any claim to be processed within 15 days of deliveryRoute protection charges are non-refundable after an order is marked fulfilled, fulfilled orders are marked as shipped, partially shipped or completed.

  11. Shipping Options and Carriers

 

California Candle Supply ships with UPS, FedEx, USPS, and we offer a fair number of freight services by request. We reserve the right to change the shipping method on any order. This may usually be done to accommodate for better package protection or to ship with a more economical method. Our website will offer shipping to most US and Canada based locations. For other countries please inquire by e-mail for a custom order. 

  12. Pick Up In Store

 

You may choose to pick up your item(s) from our California Store in lieu of paying for shipping by selecting the Pick-Up In Store option at check out. Our address and hours of operation can be found on the About Us section of our webpage. Please include the Day and Time you wish to pick up your items in the order comments at check-out. If you do not include your desired pick up day we will assume you want this order on the next business day. After an order is prepared the customer has 72 business hours to pick the order up otherwise the order may be cancelled. Orders are prepared within 24 business hours (business hours do not include holidays or the weekends). Orders placed after 4 pm PST are considered to be placed next day. When the order is fulfilled you will be sent an e-mail stating that your order is ready for pick-up. If you cannot make your appointment for pick-up an email or phone call is appreciated. If you first selected this option, but now wish to have your items shipped please reach out to us by phone or e-mail so we may bill you for the cost of delivery. It is the customer’s responsibility to check the accuracy of their order and the items received. This includes that the customer checked the products quality, quantity, and that the product itself is correct as it is the item the customer purchased as it is reflected on the invoice. For any reason if a customer wishes to exchange or return a product the product must be returned to California Candle Supply in an unused/sellable condition. California Candle Supply will not ship or pay for shipping to correct any pick up order. For this reason we recommend that our customers check the contents of their order when picking these items up so any corrections can be made immediately. All Will Call Orders picked up are considered orders and fall under all the terms and conditions that are presented in this document.

  13. Errors, Price Discrepancies, Quotes

 

In the event of a website or shipping quote error California Candle Supply is not held responsible for honoring or fulfilling the quote/price displayed on the California Candle Supply website or on a California Candle Supply invoice. California Candle Supply reserves the right to modify or cancel any order. Discrepancies and Errors will be handled on a case by case basis. Please report any website errors by emailing us at info@calcandlesupply.com or by contacting us via the support tab.

Cancellation/Refund Policy

You may cancel an order before it has shipped out, however your order may subjected to a $5.00 processing fee due to the reason of cancellation. All order cancellations are reviewed individually.

Third Party Accounts

You will be able to connect your Cal Candle account to third party accounts. By connecting your Cal Candle account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by Cal Candle from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Cal Candle Content accessed through calcandlesupply.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Cal Candle agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

CALIFORNIA CANDLE SUPPLY AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALIFORNIA CANDLE SUPPLY AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF CALIFORNIA CANDLE SUPPLY OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Cal Candle reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Cal Candle as a result of this agreement or use of the Site. Cal Candle's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Cal Candle's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Cal Candle with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Cal Candle with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Cal Candle with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Cal Candle reserves the right, in its sole discretion, to change the Terms under which calcandlesupply.com is offered. The most current version of the Terms will supersede all previous versions. Cal Candle encourages you to periodically review the Terms to stay informed of our updates.
